Terms & Conditions of Sale

Not too many of us like to have to think about the 'small print': terms and conditions, and all such legalities, but this stuff is important so here goes...

These Terms and Conditions of Sale, for orders and deliveries from our online shop, form a legally binding contract between us ("the Company") and you ("the Customer"). Your acceptance of these Terms and Conditions of Sale is given when you purchase Goods from us. You should read these Terms and Conditions of Sale carefully before buying anything from this website.

1. Conditions of Contract

No contract will subsist between you and us for the sale of product(s) or service(s), unless and until we accept and confirm your order in writing or by email. The contract when formed will be deemed to have been concluded in Scotland and will be interpreted, construed and enforced in all respects in accordance with the laws of Scotland and will be subject to the jurisdiction of the Scottish Courts.

In the event that any clause within these terms is deemed at law to be unreasonable or unenforceable, such clause will be deleted and such deletion will have no bearing on the validity or interpretation of the remaining clauses.

2. Price and Payment

For UK postal codes, the price you see is the price you pay, inclusive of standard delivery and other charges. Where any additional charges apply, for example freight for international delivery, these will be highlighted before payment.

The price of the contract will require to be paid in full prior to dispatch of the products unless otherwise agreed. Payment is of the essence of the contract and we will be relieved of any obligation under the contract if payment is not made in accordance with the contract terms.

We reserve the right to vary prices without notice. We may also, from time to time, offer discounts or special promotional prices. The contract price will be the price quoted in the contract confirmation.

Whilst we will try to ensure that all the prices on paterson-arran.com are accurate, it is possible that errors might occur. If we discover, or are informed of, any error in the price of the goods you have ordered we will rectify this and inform you as soon as reasonably possible. You will be given the option of re-confirming your order at the correct price or cancelling your order. If we are unable to contact you using the contact details you provided during the order process, we will treat the order as cancelled and notify you by email.

All transactions will be denominated by default in GBP.

3. Payment and Personal Data Security

To facilitate effective processing of orders, we offer secure payment facilities online, via the website, and can accept payment by major credit cards, debit cards or PayPal. To this end, cookies are used by the website server to track order details only and you are asked to accept these files from the website server.

Personal details are encrypted during transmission and stored and used strictly in accordance with the Company’s data protection policy and will not be passed to any third party without your explicit permission. 

4. Availability

We list availability information for products sold by us on the website in the online shop product information page. Beyond what we say on that page, or otherwise on the website, we cannot be more specific about availability. As we process your order, we will inform you by email as soon as possible if there is any change or delay in availability for any products you order. You will not be charged for any product we are unable to dispatch.

5. Customs

When ordering products for delivery outside of the EU you may be subject to import duties and taxes, which are levied once the package reaches the specified country of destination. Any additional charges for customs clearance must be borne by you as we have no control over these charges. Customs policies can vary widely from country to country, so you should contact your local customs office for further information.

Additionally, please note that when ordering from us, you are considered the importer of record and must comply with all laws and regulations of the country in which you are receiving the products. Your privacy is important to us and we would like our international customers to be aware that any cross-border deliveries may be subject to opening and inspection by customs authorities.

6. Delivery

Delivery of products ordered from stock will normally be made to UK postal codes within 3-5 working days from receipt of order. The standard delivery cost will be incorporated into the contract price, for all UK delivery, unless otherwise stated. International delivery charges will be higher, and delivery lead times longer. 

We will endeavour to ensure timely delivery of all orders. Time of delivery will not be of the essence of the contract, as actual delivery to you will be made by independent carrier and is outside of the direct control of the Company.

7. Cancellation

If you  contract with us as a consumer online, you have the right to cancel, under the Consumer Protection (Distance Selling) Regulations 2000, all or part of your contract at any time up to 7 working days after the day on which you receive the goods or services you ordered. Any paid delivery charge will be refunded if you return all of your order. You must take reasonable care of the goods while in your possession and they must be returned to us.

Where we deliver products to a third party in accordance with your order, you will only be able to exercise this cancellation right if you can return the goods to us.

8. Returns

In the unlikely event of products being faulty or of sub-standard quality, please report the problem to us immediately, using the enquiry form or contact details on the website. Arrangements for the return of such product will be made and the cost of return and replacement will be met fully by us. Goods should be returned together with original packaging where possible.

9. Liability

To the maximum extent permissible by law, we exclude all liability for any loss or consequential loss however incurred by you, arising from any action or omission or failure by us in connection with the contract.
In any event the maximum liability of Paterson Arran will be not more than the purchase price of the products or services under the contract, should the contract be cancelled for any reason.

We will not be liable for loss, damage, delay, shortage, mis-delivery, non-delivery, misinformation, or failure to provide information in connection with your shipment caused by events we cannot control, including, but not limited to, acts of God, perils of the air, weather conditions, mechanical delays, acts of public enemies, war, strikes, civil commotions, or acts or omissions of public authorities (including customs and health officials) with actual or apparent authority.

10. Notices

All communications in connection with the contract will be deemed to have been served if sent by ordinary mail to your postal address or by email to your email address, as notified to us.
Communications to Paterson Arran should be addressed to Paterson Arran Limited, The Royal Burgh Bakery, Livingston, EH54 5DN.

11. Age Restriction

We do not sell products for unsupervised online purchase by children. We sell products, which children might enjoy, for online purchase by adults. If you are under 18 you may use paterson-arran.com for purchase, but only with the approval and direct involvement of a parent or guardian.

12. Allergens

All products are produced in an environment where nuts may be present and could possibly contain traces of nuts.  All allergens are highlighted in capitalised form in the nutritional and ingredients information section of each product page on the website. We advise any customer with allergy concerns to also check the specific product label before use.

13. Mailing List

During any purchase, you may be offered the chance to join our mailing list to receive periodical newsletters and emails. You can choose at any time to opt out if you do not wish your details to remain in our database.

14. Amendments to the Conditions of Sale

We reserve the right to make changes to our website, policies and terms and conditions, including these Terms and Conditions of Sale, at any time. You will be subject to the terms and conditions, policies and Terms and Conditions of Sale in force at the time that you order products from us, unless any change to those terms and conditions, policies or these erms and Conditions of Sale is required to be made by law or government authority (in which case it may apply to orders previously placed by you). If any of these Terms and Conditions of Sale is deemed invalid, void, or for any reason unenforceable, that condition will be deemed severable and will not affect the validity and enforceability of any remaining condition.


15. Royal Highland Show Foam Fingers - Free Paterson’s goodies

Send in a photo of yourself with our Paterson’s foam finger from the Royal Highland Show, and receive a free Paterson’s product. Free product will be of our choosing, and will be delivered free of charge via Royal Mail. One free product per person, per address. UK addresses only. Please send us your pictures via email, Facebook, Twitter or Instagram, by 31st July 2019.
